General Terms and Conditions immo-invest.ch
These General Terms and Conditions (hereinafter “GTC”) govern the use of the website www.immo-invest.ch. These GTC also govern the purchase of digital and printed products that are subject to a charge.
With the use of the digital offers and/or the purchase of chargeable Products, the user confirms that he has read, understood and accepted these GTC accept them.
Registration
Certain digital offers require registration or a login at immo-invest.ch. Whether registration or login is required will be indicated at the appropriate place.
Chargeable Products
Users can purchase fee-based products on immo-invest.ch. These can be paid for by credit or debit card. Buyers’ credit and debit card details are encrypted using SSL technology. Each transaction is authorised online by the relevant credit or debit card company. The credit or debit card number of the buyer is not stored by immoMedia GmbH.
A purchase is binding as soon as the buyer clicks on the “Finalise order” button and is completed when full payment is made to immoMedia GmbH. The purchased products are then activated for the buyer.
immoMedia GmbH reserves the right to cancel purchases due to circumstances beyond the control of immoMedia GmbH (force majeure, official or court order, etc.) at no cost to the purchaser.
All prices are quoted gross in CHF (Swiss francs), including statutory value added tax (VAT). The published price at the time of the order is decisive. Technical changes, errors, typographical and printing errors are reserved. immoMedia GmbH reserves the right to change prices at any time.
Any Ancillary costs (if applicable) will be shown separately in the order process and charged additionally.
Intellectual property rights
immoMedia GmbH is the owner and operator of the digital offers. All trademarks, names, logos, images, photos, graphics, designs, content, texts (including advertisements), layouts, software and other materials used there belong to immoMedia GmbH or authorised third parties. The (complete or partial) reproduction, transmission (electronically or by other means), modification, linking (including framing) or use of such elements for public or commercial purposes is prohibited without the prior written consent of immoMedia GmbH.
Exclusion of liability
immoMedia GmbH is only liable for direct damage caused by wilful or grossly negligent breach of its contractual or statutory obligations. Liability on the part of immoMedia GmbH for direct damage in the event of slight negligence or for indirect damage (such as loss of profit) – irrespective of the legal grounds – is excluded, subject to mandatory statutory provisions.
immoMedia GmbH endeavours to ensure that the content on the digital offers is correct at the time of publication; however, no assurance or guarantee can be given regarding the completeness, accuracy or reliability of the content.
Furthermore, immoMedia GmbH assumes no guarantee for the functioning or the uninterrupted and constant availability of the digital offers for the complete and correct reproduction of the contents.
immoMedia GmbH accepts no liability for loss of data or for errors for which it is not responsible, in particular for errors by operators of telecommunications services, access and hosting providers, etc., or for technical failure or malware, in particular malicious software.
immoMedia GmbH reserves the right to partially restrict or completely switch off the digital offers at any time without prior notice and to adapt the offer. Any liability in this connection is excluded in full and claims by users are excluded, in particular claims for reimbursement of fees or payments already made and/or for damages.
The digital offers may contain links to third-party websites or offers. These sites are not operated or monitored by immoMedia GmbH. immoMedia GmbH accepts no responsibility for the content and operation of linked websites or offers.
Validity
The Invalidity of individual provisions shall not affect the remaining validity of these GTC shall not be affected.
Amendments of the GTC
immoMedia GmbH reserves the right to amend these GTC at any time. The amended GTC shall be brought to the attention of users by notification in a suitable place on the digital offers. The new version of the GTC shall apply from the date of publication.
Subsequent Amendments to the GTC shall be deemed to have been approved by the user if the user does not the new GTC in writing within 14 days of becoming aware of the amended GTC objected to in writing. With the continued use of a digital offer, the user recognises the the user recognises the respective valid GTC.
Place of jurisdiction and applicable law
The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is the current registered office of immoMedia GmbH, subject to mandatory jurisdictions.
Swiss swiss law shall apply to the exclusion of the Federal Act on Private International Law (IPRG) and the Vienna Sales Convention (CISG).
